These General Terms of Use and Contracting (hereinafter referred to as the "Conditions") regulate access to and use of the website accessible through the domain name https://www.huitech.es/ (hereinafter, the "Site" or "Website"), as well as the acquisition of the service offered through it. The mere access to the Website attributes to the user (hereinafter, the "User" or "You") and implies the acceptance of all the terms included in these Terms and Conditions.

By accepting these Terms and Conditions, the User declares that they have read, understood, and accepted what is established in these General Conditions.

1. General Information

The domain huitech.es on the Internet is owned by HUITECH SOFTWARE PARTNER S.L.U. Huitech reserves the right to make changes to its headquarters without prior notice, in order to update, correct, modify, add, or delete its content or design.

Huitech expressly prohibits "framings" or the use by third parties of any other mechanisms that alter the design, original configuration, or content of its website.

2. Access to the Website and Service Specifications

Mere access to the Website is free, except for the cost of the connection through the telecommunications network supplied by the User's contracted access provider.

Huitech informs Users that these General Conditions may be modified or amended at any time. Therefore, Huitech will notify any changes through the website or any other contact method. Consequently, the User must carefully read these Terms and Conditions as many times as necessary to correctly use this Website and subscribe to its Services.

The services provided by Huitech (hereinafter, the "Services") aim to be consultancy and software development services.

3. Website and Service Rules

The person who uses the Website is considered the User. Taking this into account, we understand that You may be classified as an individual, a company, a research and development organization, the Government, or even a nonprofit organization, among others.

In the event that the User fails to meet the obligations established on this Website, Huitech reserves the right to prohibit or deny the use of the Website or the Services offered on it.

4. Intellectual and Industrial Property

The content of the Website, including but not limited to technology, software, as well as its graphic design and source codes, is considered as the content of the Website. All of these are the intellectual property of Huitech, and none of the exploitation rights recognized by current intellectual property regulations can be understood as assigned to the User.

The User declares to be the sole author of all photographs, images, texts, and/or comments (hereinafter, "User Content") that they publish or send through the sections of the Website designed for this purpose, guaranteeing that their use on the Website does not infringe the rights of any third party.

The trademarks, trade names, and other distinctive signs published on the Website are the property of Huitech or third parties and/or licensors, without granting the User any rights over them.

5. Right of Withdrawal

In accordance with the provisions of Royal Legislative Decree 1/2007, of November 16, approving the General Law for the Defense of Consumers and Users and other complementary laws, the right of withdrawal establishes that the User can withdraw from the contract concluded through the Website within a period of 14 natural days without the need for justification. However, the regulation establishes specific considerations as cases of inapplicability of the right of withdrawal.

According to article 103 of Royal Legislative Decree 1/2007, of November 16, approving the General Law for the Defense of Consumers and Users and other complementary laws, paragraph a) the User cannot withdraw from the following contracts:

The provision of services, once fully executed, when the execution has begun, with the prior express consent of the User and with their acknowledgment that, once the contract has been fully executed by Huitech, the User will have lost the right of withdrawal.

And paragraph m):

The supply of digital content that is not provided on a tangible medium when the execution has begun with the prior express consent of the consumer and user, with their knowledge that as a result, they lose their right of withdrawal.

Therefore, since Huitech operates within the aforementioned paragraph m), the User loses the right of withdrawal by accepting the terms and conditions of use.

6. Complaints, Claims, and Information Requests

The User can share their complaints, claims, and/or information requests with Huitech by sending an email to hola@huitech.es.

Huitech has official complaint/claim/request forms that the User can request.

7. Disclaimer

Huitech is not responsible for damages and/or losses and/or loss of income to any User or third party harmed as a result of opinions, statements, data, and/or content, if any, that the User and/or third parties may display directly or indirectly for any reason, at any time, and in any way on the Website. Huitech does not guarantee that the Site will operate constantly, reliably, and permanently, without delays or interruptions.

As a result, Huitech is not responsible for any damage and/or loss of income by any customer or third party negatively affected as a result. Huitech is not responsible for any damage and/or loss of income to any User or third party harmed as a result of force majeure, fortuitous event, failure, or error in communication lines or defective Internet service or defective connection. Huitech is not responsible for damages and/or losses caused to any third party by the use of banking data without their consent by any User who contracts the Services.

Huitech has taken all legally required security measures to protect the personal data provided by the User. However, Huitech cannot guarantee the absolute invulnerability of its security systems or the security or inviolability of such data during transmission over the network.

As a service provider, Huitech does not control the use that the User makes of its Service. Huitech is not responsible for the use and/or content that the User may make contrary to laws or these General Conditions and/or the relevant additional conditions, to the extent that Huitech is not responsible for the content of the information and/or data transmitted, nor does it originate the transmission, modification, or selection of data or recipients. Therefore, only the User is responsible for the consequences that may arise from unlawful or contrary use of these conditions, as well as the truthfulness and/or lawfulness of the content posted by the User. For these purposes, the User will use the Services in accordance with the applicable law.

8. Confidentiality

Huitech and its employees and technical service personnel will seek and maintain the confidentiality of all User information to which they have access by any means and will not use, disclose, or allow it to be used or disclosed. At the User's request, they will do their best to destroy or immediately return such information if it is recorded for any reason and/or by any means, when, in compliance with the contracted Services and in accordance with the established Terms and Conditions, they are given access to the User's information of any kind. In all these cases, the applicable legislation will apply.

9. Nullity and Ineffectiveness of Clauses

If any clause included in these General Conditions is declared wholly or partially null or ineffective, such nullity or ineffectiveness will only affect said provision or the part thereof that is null or ineffective, with the rest of the General Conditions remaining in force in all other respects and the provision being considered as not included, either wholly or partially.

10. Applicable Law and Competent Jurisdiction

These General Conditions will be governed and interpreted in accordance with Spanish law.

Whether the User does not have the status of a consumer or user, the User agrees to submit any dispute arising from the use of the Website or the subscription process to the Courts and Tribunals of Valencia, expressly waiving any other jurisdiction that may correspond. On the contrary, when the User has the status of a consumer, in the event of a dispute, they may choose to file their claim with the Courts or Tribunals corresponding to their domicile.
